  • This Liability Release Agreement ("Agreement") is made and entered into as of date below and signed by and between Little Moo Ranch, (Emberly Hill), whose address is 250 Meadow Brook Ct., Springtown, Texas 76082, and ("Participant") named below.

    1. Acknowledgment of Risks

    1.1 Participant acknowledges and understands that working with farm animals, including but not limited to horses, cattle, sheep, goats, pigs, poultry, or other livestock, involves inherent risks. These risks include, but are not limited to, bites, kicks, scratches, trampling, unpredictable behavior, allergic reactions, and zoonotic diseases. 1.2 Participant further acknowledges that the environment of a farm may pose additional risks, such as uneven terrain, exposure to weather conditions, equipment hazards, and potential allergic reactions to hay, feed, or animal dander.

    2. Assumption of Risk

    2.1 Participant voluntarily assumes all risks associated with working with and around farm animals and agrees that Farm Owner/Operator shall not be held liable for any injury, illness, damage, or death resulting from these activities.

    3. Release and Waiver of Liability

    3.1 In consideration of being permitted to work with farm animals, Participant agrees to release, waive, discharge, and hold harmless Farm Owner/Operator, its agents, employees, volunteers, and assigns from any and all claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may occur as a result of Participant’s activities on the farm or interaction with farm animals.

    4. Compliance with Rules and Instructions

    4.1 Participant agrees to follow all safety instructions, rules, and guidelines provided by Farm Owner/Operator, including the proper handling of animals, use of equipment, and maintenance of a safe environment.

    5. Indemnification

    5.1 Participant agrees to indemnify and hold harmless Farm Owner/Operator from any and all claims, demands, losses, or damages, including attorney’s fees, arising out of or related to Participant’s acts or omissions while on the farm.

    6. Texas Equine and Livestock Liability Act

    6.1 Participant acknowledges that this Agreement is governed by the Texas Equine and Livestock Liability Act (Texas Civil Practice and Remedies Code Chapter 87), which limits the liability of farm operators in connection with inherent risks of farm animal activities. Participant has read and understands the Act’s provisions.

    7. Governing Law

    7.1 This Agreement shall be governed by and construed in accordance with the laws of the State of Texas.

    8. Severability

    8.1 If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

    9. Entire Agreement

    9.1 This Agreement constitutes the entire understanding between the parties regarding its subject matter and supersedes all prior agreements, discussions, or representations.

    10. Signature and Acknowledgment

    By signing below, Participant acknowledges that they have read, understand, and voluntarily agree to the terms of this Agreement. Participant further acknowledges that they have been provided with an opportunity to ask questions and seek legal counsel prior to signing.
